RULES AND REGULATIONS
SCOPE OF RULES AND REGULATIONS

RESOLUTION NO 1994-4 dictates the Board policy recognizing, acknowledging and ratifying the existence of certain Rules, Regulations, By-Laws and Covenants, Conditions and Restrictions.

PLEASE NOTE: Where reference is made to a RESOLUTION, refer to the Resolution section of the Handbook (back section) for the entire verbiage and content of the Resolution.

ALL PROPERTY OWNERS themselves are responsible for violations, fines etc. of any guests, individual(s) renting or in any way using said property or facilities through said Property Owner(s).

ABANDONED VEHICLE (S) - These vehicles are prohibited in the Community as per the Protective covenants Article IX, Sec. 1; also #20. An abandoned vehicle is a vehicle that remains within the Community for more than 4 weeks in a condition such that the vehicle is either, (a) without current inspection sticker or similar certification in the state in which the vehicle is registered, (b) not currently registered in any state as a motor vehicle pursuant to the motor vehicle laws applicable to said state. If such vehicles are not removed immediately, the property owner is subject to a fine of $50.00 per day for each day the vehicle remains on the property. The vehicle will be towed, with the property owner bearing the burden of the cost of towing plus any other additional costs involved.

ABUSE - Verbal/physical abuse/harassment of any employee agent or property owner of the Association is prohibited. Refer to RESOLUTION NO 1997-4. Violators are subject to a fine of not less than $100 up to $300/occurance.

ACT 180 - RE-SALE DOCUMENT: All property owners who are selling their house must provide the buyer with a copy of I. R. Re-Sale Documents as per Act 180. A request form is to be filled out and presented to the office along with a check in the amount of $50.00. This is required within a set time period of when both parties have signed an “Agreement of Sale.”
As of 1/1/05 the amount for the Re-Sale Document is $100.00.

ADVERTISING SIGNS - Advertising signs of any type or For Sale or Rent signs are NOT permitted to be displayed on any lot or the exterior of any living unit as per the Protective Covenants. However, one (1) For Sale sign will be allowed to be displayed inside a house window. No signs of any type are to be displayed on a lot.

ADMINISTRATIVE RECORD SEARCHING OF PROPERTIES - There is a fee charged for a search of property(ies) for any year prior to the current year. Refer to Resolution NO 1998-1.

ALCOHOLIC BEVERAGES - No consumption of any alcoholic beverage(s) or use of any type of alcoholic beverage on any Association owned property is allowed. When a property owner or guest is apprehended for this violation, a fine of $500.00 will be levied against the property owner. The property owner will lose his/her Association privileges to the Community docks, pool, tennis courts, beaches, lake and pond usage for a period of one (1) year, these privileges will not be returned until the fine is paid. Drinking by anyone under 21 years of age on any Association owned property will constitute a fine, as stated above, notification of the parents or in the case of a guest, the property owner and the State Police. Possession or consumption of alcoholic beverages by persons under 21 years of age is prohibited. (Pennsylvania State Law).

Association owned property includes, all roadways, beaches, lakes, docks and all accesses, boat launch and access, picnic areas, pond and all Association owned property in and around the pond area, tennis courts, pool, bath house, all parking areas, children's play areas and "all Green area owned by the Association".

ANNUAL MEETING - The Annual membership meeting is held during the months of June or July on a weekend, the time, date and place to be designated by the Board with notice to the property owners by means of the Indian Rocks Newsletter, the official means of communication from the Board to the members. Refer to Resolution NO 2000-3

ANTENNAE- Refer to Cable TV and Satellite Dish. Cable is available through Adams Cable TV (1-888-222-0077). Satellite dish is allowed but plans are to be submitted to the AC for review and approval. A fine of $100.00 is attached to the property owner’s account if plans are not submitted and approved. Location on the dwelling is to be in such a manner to shield the dish as much as possible from view from the street or other common property and from neighboring lots. A dish can be no larger than 18" in diameter.

ARCHITECTURAL CONTROL COMMITTEE - Consists of volunteer members, in good standing, of the Property Owners Association. Any property owner wishing to serve on this committee, contact the Association office. The A.C. Committee usually meets the 1st or 2nd Saturday of the month. If there is no business for the committee there will be no meeting. Any property owner who is planning any type of exterior work (addition, painting, replacement, repainting, sheds etc.) is to apply to the ACC for approval. All applications are to be submitted no later than one week before the meeting. If in doubt, call the office. Applications submitted after this date may not be approved until the next months meeting. Assessments must be current on all properties owned by the applicant.

ARCHITECTURAL CONTROL GUIDELINES - Refer to Resolution NO 1996-7 & Resolution NO 1998-4. A sample copy of the New House Construction application and a modified application for all exterior work is printed in the Handbook. This includes new home construction, all exterior maintenance and/or additions or repairs. Copies may be downloaded from the IR web site (www.indianrocks.com) and e mailed to the office. ARCHITECTURAL CONTROL GUIDELINES VIOLATIONS - Refer to Resolution NO 1996-7 and Resolution NO 1998-4.

ASSESSMENTS - Statements are sent to the Property Owners by January 1 of the current year. The Assessment is due and payable on or before March 31, of the current year. Anyone leasing a dock slip must have their Annual Assessment and the dock slip fee paid by March 31, of the current year. A finance charge (check with the association office for current percentage rate) is applied to the account, on the unpaid balance, beginning April 30. Refer to Resolution NO 1994-2 for the Board policy to disconnect water service to a developed or undeveloped property for the non-payment of the Annual Assessment and/or any future Special Assessment.

ATV'S - RECREATIONAL VEHICLES. - Speed limit 20 MPH. All ATV’s need to be registered in the state that they were purchased. A copy of the registration, plate and certificate of insurance is to be on file. IR flags & id #'s a must.

AUDIO DEVICES - The operation of audio devices in such a manner as to disturb other individuals is prohibited.

BEACHES & POOL - The beaches and pool are opened daily from approximately the 3rd. weekend in June up to and including Labor Day. Check the Indian Rocks Newsletter or the office for a definite date. Weather permitting and the availability of lifeguards, Tanners Point beach will be open weekends (Saturday/Sunday) starting on Memorial Day. (Check with the office for verification or the Bulletin Board at the main entrance). Pool and Beach Regulations are posted at each site.
1. All swimming facilities will usually have a full time, certified lifeguard on duty during the hours of 11:00 a.m. – 5:00 p.m.
2. THERE IS NO SWIMMING AT ANY OF THE FACILITIES WHEN A LIFEGUARD IS NOT ON DUTY.
3. Current tags must be displayed.
4. Rules and Regulations are posted at the Beaches and Pool and are enforced by the Lifeguard(s) and upheld by the Board of Directors and Management.
5. No pets or animals of any type are allowed at or in the vicinity of the Beaches & Pool. PADEP license regulation.
6. ALCOHOLIC BEVERAGES ARE PROHIBITED.
7. All cars in the parking areas of these facilities must display a current Indian Rocks sticker.
8. No children 12 or under are to be left unattended at the Beaches or Pool. They must be accompanied by an adult 16 years of age or older.
9. No running, jumping or horseplay is permitted. Includes flips, back dives or other stunts. Insurance liability.
10. Clothing other than bathing suites is not to be worn in the pool. (No cut-offs).

BLASTING OF CONSTRUCTION SITE - Any lot that requires blasting for excavation/foundation must be approved by the A. C. C. A qualified, experienced demolition technician certified by the state of PA must do the blasting. Forty-eight hour notice, in writing, must be given to all occupants of lots within 1,000 feet with a copy of said notice on file in the Association office.

BOARD OF DIRECTORS MEETINGS - Held the 4th Saturday of the month, except May, June, August, and December at 10:00 a.m. Property owners in good standing are invited. There is a 15 min. Open Forum whereby PO may make constructive comments.


BOATS - The maximum length of boats assigned to Indian Rocks Community Docks is 24 feet. All boats must be registered at the Association office. A "current registration" along with a certificate of insurance is to be submitted to the Association office by March 31 of the current year before a slip will be assigned to a property owner, in good standing. These are submitted on a yearly basis. If no current registration is on file, the property owner will be mailed one (1) notice and have ten (10) days to correct the situation. If the current registration is not received in the Association office within the ten (10) day time frame, the slip will be assigned to another property owner and the slip rental fee (pro-rated) will be returned to the initial property owner. An Indian Rocks sticker, with a specific registration number will be assigned to each property owner and must be displayed on the side of the boat facing the shoreline and low enough that it can be viewed from the shore with the boat cover in place. Notification of dates for placing the boats on Community Dock in the Spring and removing them in the Fall will be through the "Indian Rocks Newsletter" along with notice on the main entrance Bulletin Board and the web site.

It is the Property Owners responsibility to have their boat off Community docks on or before the particular date of removal. Indian Rocks is not responsible for any boats not removed from the docks in the fall. Any Property Owner leasing a slip on community Dock, must have their Assessment paid in full along with the current slip rental fee, by March 31 of the current year. The Association, Board of Directors or its employees are not responsible, nor will incur any responsibility or liability for any reason, for any/all boats that incur damage by fire, vandalism, theft or any other means, while parked on/at the Community Docks.

PLEASE NOTE: If you already have an existing, traditional boat on Community dock and you decide to change to a PONTOON or larger vessel check with the office first. The pontoon boat may not fit in your dock slip due to the wider width of these particular boats. Since the Association attempts to accommodate as many property owners as possible, there may not be another slip available for the pontoon. Consideration for the other boat owner is a concern and damage from your boat will be your responsibility.

BOAT LAUNCH - The launch is for Indian Rocks Property Owners only. All vehicles are to have displayed a current Indian Rocks sticker as well as the boat or water recreational vehicle being launched. No alcohol permitted in the area.

No cars or other type of vehicles are allowed to be parked at the launch area or the driveway leading to the ramp. They are to be removed immediately after the boat is launched in the water. Please be considerate of other members waiting to launch.

BOAT SLIP- Boats must be in the slip by July 4th. of any given year. If the boat is not in the assigned slip, and there is no approved, written request or excuse stating an emergency, the slip will be assigned to another Property Owners and the monies paid will be returned on a pro- rated basis. Maximum length of a boat is 24'. The current years assessment, water fee, and slip rental fee must be paid by March 31 of the current year or the slip is reassigned to another Property owner.

No boat is to be tied up to the outside of an existing dock or tied at the shoreline. All boats on Indian Rocks shoreline are to be in an assigned slip.

Slips are not transferable when a house or lot is sold. The new owner will be placed on a waiting list. A boat placed on Community Dock over the 24' limit must be removed immediately, the owner gives up his/her privilege to a slip and there is a fifty ($50.00) dollar per day fine attached to the assessment, for every day the boat remains at the Community dock. If necessary, litigation will follow. These same rules apply to a property owner who rents his/her house whether daily, weekly, monthly, seasonal or yearly. The property owner is responsible for their renter. No Property Owner may charge a renter(s) a slip rental fee for more than the cost of the slip for that current year. The same fine is imposed as for the over 24’ limit and immediate loss of the privilege of docking a boat on Community dock. No dock is to be placed on the Indian Rocks Property Owners Assn., Inc. of Ledgedale shoreline on Lake Wallenpaupack by an individual property owner. All permits are obtained from P.P & L. by the Association. The same fine is imposed for this violation as for the over 24' boat limit, plus an additional fine of five hundred ($500.00) dollars for every two (2) week period the dock is in the water or at the shoreline. All fines become part of the Assessment and amenity use is based on a "member in good standing" policy.

BOAT SLIP ASSIGNMENT – Boat slips are assigned on a year-to-year basis. Property owners who have leased a boat slip the previous year will have the option to lease the same slip again. Only when they choose not to lease again will that slip become available. Property owners who want to lease a slip for the first time must inform the association office and they will be put on a waiting list. All boat slips are assigned in April. After all Property owners, who have previously leased a dock slip and have paid their current Assessment and rental fee in full have been assigned, then the property owners on the waiting list, who are in good standing, will be assigned a slip if there are any available. Property owners will be notified by mail if and when a slip has been assigned to them. At that time, the association will require the boat slip fee paid in full and a copy of CURRENT insurance and CURRENT registration for the boat. A property owner will then be assigned a sticker.



BUILDING REGULATIONS: Building plans are reviewed and enforced by the Architectural Control Committee. Building permits from Indian Rocks Property Owners Association as well as Salem Twp. are required. This also applies to existing houses whenever any exterior replacements or changes are made to the structure. A copy of the current Indian Rocks Architectural Control Guidelines, building rules and regulations and permit application is available on the website or contact the Association office during business hours 8:00 a.m. - 4:30 p.m., Monday through Friday. Contractors and sub-contractors working hours are Monday - Saturday 7:30 a.m. - 5:00 p.m. These same hours apply to a Property Owner. Homeowners doing routine maintenance work on Sunday, only between the hours of 9:00 a.m. - 4:00 p.m. All contractors and subs are to display a current year Indian Rocks contractor's pass. See A.C.C. permit application for a list of fines.

BURGLAR AND/OR FIRE ALARM - All homeowners who have either or both alarms must register their alarm system with the IRPOA office. All alarms are to be connected to a central command system for response. Do not use the Indian Rocks phone number.

BY-LAWS - Authorization to enforce - Refer to Resolution NO 1996-5.

CABLE TV - Cable TV is available through Adams CATV, Inc., 19 N. Main Street, Carbondale, PA 18407 1-888-222-0077. No large satellite dishes are allowed in the Community. A satellite dish is a generally circular shaped device for radiating or receiving radio waves and particularly TV signals from satellites. Satellite dish is to be no larger than 18" in diameter. Plans are to be submitted, before installation, to the ACC for approval. A fine of $100.00 will be attached to the P.O. account if plans are not submitted and approved. Location on the dwelling is to be in such a manner to shield as much as possible the dish from view from the street or other common property and from neighboring lots.

CAPITOL IMPROVEMENT FEE- Refer to resolution NO 2002-1 There is a transfer fee when new property is purchased.

CHECKS (RETURNED) - A fee of thirty ($30.00) dollars will be charged to any property owner(s) account if a check is returned, for whatever reason. The Association is charged by the lending institution and the reverse - accounting process is time consuming for the office. Payment for the returned check will be accepted only in the forms of cash, certified check or a bank or postal money order.

COMMON PROPERTY - Is for the use of all and may not be used for private gathering, parking, parties, game playing etc.

CONTRACTORS - Refer to Architectural Control Guidelines. Current contractor vehicle sticker is to be displayed along with a current certificate of insurance on file at the Association office. A $50.00 fine is assessed to the property owner’s account for each violation Refer to Resolution NO 1998-3.

DELINQUENT PROPERTY OWNER - Refer to Resolution NO 1993-5, Resolution NO 1996-3 and Resolution 1996-4. (This Resolution amends Resolution NO 1975-5) Collection of all fees - Fees include attorney’s fees, filing, and transfer of Judgment, finance charges, late charges, penalties and administration fees. Finance charges run from the date of delinquency until the date of payment whether or not the delinquency was reduced to Judgment. A fee of $500.00 is assessed against every P.O. or party delinquent in his/her/it’s delinquent dues/assessments for a second (2nd) or successive filing of a magistrate or other lawsuit for the collection of said delinquent dues/assessments.

DOCKS - Association owned docks on Lake Wallenpaupack are an asset to Indian Rocks. However, they have the potential of being a liability. The following rules prevail: (a). No fishing, diving, swimming, skiing, or sunbathing on any of the boat docks; (b). Skiing from or the operation of wet bikes, jet skis etc. in or around the dock areas, within 50' is prohibited. (Refer to the lake rules and regulations for skiing in coves, high traffic areas and areas that are prohibited on holidays and week-ends); (c). Children 12 years and under must be accompanied by an adult and are not to be left unattended on or around the docks; (d). Alcoholic beverages are not permitted; (e). Remove all trash and place in a proper receptacle; (f). Rugs, rubber strips, hooks, bumpers of any type etc. are not to be attached to Association docks; (g). If rings need to be replaced, contact the Association office; (h). All walkways are to be kept clear at all times.

DOGS - The Pennsylvania Dog Law provides stiff fines for persons who allow their dogs to run loose. All dogs must be leashed on their owners property at all times and must have displayed a current license no later than January 1 of each year. See Pets, also #17 Protective Covenants. A dog license may be obtained at the Wayne County Court House, Treasurer's Office, Honesdale, PA. 18431 or at the IR Association office.

DRAINAGE DITCHES/CULVERT PIPES - must be kept cleaned at all times and maintained by the property owner. Maintenance directs if a property owner needs to install a pipe. Galvanized or plastic with a smooth interior (for flow) can be installed.


DRIVEWAYS - Driveway width not to exceed 15'(entrance may flange out to 20' at entrance). If it is determined by Indian Rocks maintenance that a culvert pipe is necessary, this is to be installed at the property owner(s) expense. The pipe specifications will be dictated by Indian Rocks (e.g. diameter, length, head walls and # of feet to extend past the width of the driveway itself. Maintenance of the pipe is the responsibility of the property owner(s), this includes keeping the interior of the pipe free of dirt and debris. Type can be galvanized or plastic and must have a smooth interior.

DRIVEWAY - BLACKTOP - May be applied upon submitting a written request for approval to the ACC. The request is to be accompanied by a accurate plot plan indicating exact property lines, location of the house and the driveway. The Blacktop may now be extended to the road providing all of the above is complied with along wit a legal affidavit signed by all property owners of the property releasing Indian Rocks POA Inc. of Ledgedale, it's Board of Directors, members and employees from any liability for any reasons or unforeseen problems e.g., damaged due to winter and regular road maintenance and repair of water lines by the Association. The property owner(s) is responsible for cost of repair/maintenance. Contact the office.

ELECTIONS - Refer to By-Laws, Article VIII. Sec. 1-7 for election guidelines. Any member, who has been a member in good standing for a minimum of (2) two years (Resolution NO 2002-9) and is in good standing at the time he/she decides to run and remains in good standing in the Association during the duration of his/her term, may be a candidate. A resume’ to the current Board of Directors is required.

EMERGENCY 911 IDENTIFICATION SIGN-All improved property in the development of Indian Rocks, in all sections, shall be identified on a “uniformed” number sign constructed by the association and affixed to the improvement per Association guidelines for the purpose of 911 identification.

EMERGENCY - Fire - Ledgedale Volunteer Fire Co. Ambulance - Hamlin Ambulance. 911 These services are provided by volunteers and annual contributions by all Property Owners are critical to the survival of the service. Contributions are tax deductible. State Police Rte 191, Honesdale, PA (570) 253-7126. REMEMBER: Use your new 911 number and your road name.

EMPLOYEES - Abuse - Refer to Resolution NO 1997-4

EXTERIOR WORK ON HOUSES, SHEDS, GARAGES - All exterior work on any property in Indian Rocks is to be submitted to the Architectural Control Committee through the Association office for approval. An application, detailing the necessary information is available in the office or on the web site. Violators will be assessed a fine. This includes painting, roofing, window replacement, deck/steps addition, replacement, tree removal etc. Refer to the AC Guidelines in another part of the Handbook and Resolution NO 1996-7 and Resolution No 1998-4.

FENCES – Limited use of fencing is allowed when it is for the sole purpose of protecting a property owner’s landscaping from non-domesticated animals. Refer to Resolution NO 2002-6. A decorative type, natural split rail fence will be permitted. This can only be used at corners of the property, limited to two corner pieces. It is to consist of two sections with ends joined together with one post and the other ends in the ground. A written request for this type of decorative landscaping is to be submitted and approved by the Board of Directors through the ACC. Fencing around the perimeter is prohibited.

FIREARMS - Use of firearms of any kind or type along with pellet guns, bow and arrow, slingshots, blowguns, air guns etc. is strictly prohibited within the Indian Rocks Development. Violators will be prosecuted.

FIRE REGULATIONS - Recreational fires, e.g. a small, enclosed fire used strictly for cooking hot dogs, marshmallows or just sitting near etc. will be permitted if enclosed, adequately supervised, and fire suppression measures are available, e.g. garden hose and/or water bucket. PA DEP and local burning regulations are to be followed. Burning in a barrel, drum or other similar object or the burning of paper, trash, leaves, household debris, deck, steps or any wood or building material etc. is prohibited. If you have doubts, contact the Association office.

FIREWORKS - State law prohibits the use of any type of Fireworks. This includes any and all lands of Indian Rocks Property Owners Association, Inc. of Ledgedale including all of the individual Property Owner(s) private property.

FISHING - Although our Pond is private, it is subject to PA State fishing laws. A fishing license must be obtained by anyone 16 years or older. Licenses are available at the Wayne County Court House, Honesdale, & other shops in Greentown, Hamlin & Newfoundland.

GARBAGE - Garbage disposal is private and not provided by Indian Rocks. (Refer to GARBAGE REMOVAL for private company) Individual Property Owners should have a container that is equipped with a secure lid, a clamp or tie strap to secure the lid. Any Property Owner who places trash out and the contents are spilled before the trash company picks up will be subject to a fine of $50.00, each occurrence. Current stickers and tags will not be issued until the fine is cleared. A homeowner provides for his or her own trash removal.

GARBAGE REMOVAL - Garbage/trash disposal is the responsibility of the individual Property Owner in Indian Rocks. Lester Butler of Mt. Cobb, PA provides pick-up service to the Community. They can be contacted at (570)-689-2202. They provide seasonal and all year round service. The dumpster at the maintenance garage, near the Association office, is for maintenance trash only, not for individual Property Owners use. A clean-up weekend is usually scheduled at the end of June. Current information on the type of refuse that can be disposed of and the specific date for the clean up will be announced in the Indian Rocks Newsletter. A minimum fine of $300.00 is charged to a Property Owners account that dumps garbage on any of the lands of Indian Rocks Property Owners Association, Inc. of Ledgedale.

GUESTS - Property Owners are responsible for the actions of any and all "Guests". Guest car passes are to be provided by the Property Owner for display on all guest vehicles. All guests are to be provided with a copy of the Indian Rocks Rules & Regulations by the Property Owner. If you are expecting a guest and they will need to come into the association office for a one day pass, please call and inform the office so that when your guest comes in we know that they are welcomed. This is for the property owner’s own protection so that no one with an unkind or useless purpose may enter the community.

HOUSE AND TRIM COLORS - As per the Protective Covenants, paint and stain colors for the exterior of any house, garage, shed or any type of exterior building is brown earth tone. Existing houses/structures when re-painting or re-placing windows, doors, shutters, roofs, gutters etc. are to be done in a brown earth tone. Doors and shutters can be painted muted shades of green and red.. Samples of approved colors are on file in the association office. As previously stated under Building Regulations, all exterior painting, changes and additions to an existing house, must be submitted and approved by the A.C.C. prior to the application. HUNTING - No hunting or trapping is permitted on any of the lands in the Indian Rocks Development, Indian Rocks Property Owners Association, Inc. of Ledgedale This includes property owned by the individual property owner(s). Pennsylvania law requires a license for hunting on PA designated lands. Promise Land State Park is nearby and available for hunting. A license may be obtained at the Wayne County Court House, Honesdale PA 18431 or several sport stores in the area..

INDIAN ROCKS BUILDINGS - No smoking or use of alcohol is permitted in any of the buildings owned by the Indian Rocks Property Owners Association, Inc. Of Ledgedale. This includes the Administration office, Maintenance, Meeting Hall and Bathhouse.

LOTS/PROPERTY - Combination of lots in Indian Rocks. 2 or more lots can be combined for any lawful construction and eliminate the boundary lines for purposes of the Indian Rocks Architectural Control Guidelines. Outlined procedures have to be followed. Refer to Resolution NO 1997-1 for details. This does not eliminate an additional assessment(s) if the combination is over 15,000 sq. ft.

MAIL DELIVERY –For Federal Express, UPS and other deliveries, give your 911 number and street name. Regular United States Postal Service mail is not delivered to individual houses. A Property Owner(s) is not allowed to put up his own individual mailbox. A property that fronts SR 3006, Ledgedale Rd., can not put up a mail box on either side of the state road. Rural delivery to the lock boxes, located to the right of the main entrance in a covered area, is available through the Lake Ariel Post Office. For further information contact the Lake Ariel Postmaster at (570)-698-5311. All mail is to be delivered to the mail pavilion.

MAILING ADDRESS CHANGES - PROPERTY OWNERS - Refer to Resolution NO 1996-8. In the event a Property Owner or member of the Association changes his or her address it shall be that person(s) responsibility to notify the Association office in writing of the change. Until such time as the Association receives such change of address in writing, all correspondence may be properly and lawfully sent to the current address on file.

MAINTENANCE - INDIVIDUAL PROPERTIES - Requirements for maintaining individual properties are included in the recorded Protective Covenants of the Development. This requirement is enforced by the Association by first sending a formal maintenance notice to the individual Property Owner. A 15-day period is provided to take the indicated action. If, during this time period, no appropriate action is taken the matter is turned over to the Association's attorney. It is with regret that it has become necessary to take this action, but the Association feels it is warranted to preserve the value of the Community and protect the Property Owners investment. The hours for exterior maintenance in Indian Rocks are Monday trough Saturday 7:30 a.m.-5:00 p.m. Small jobs such as yard work etc. is allowed on Sundays.

MAST MOUNTED MULTIPLE ROD ELEMENTS-used to receive TV or radios are allowed following certain guidelines. Check with the office.

MEETING HALL - The Meeting Hall (Recreation Bld.) is available to the P.O. for small family parties, reunions, graduations, small receptions etc. A two (2) month advance notice is requested. An application form and release is to be filled out and submitted by the property owner to the Assn. office. The property owner is the responsible party. No alcohol or smoking is allowed. (Sample of request form is in the back of the Handbook and on the web site. The Indian Rocks Property Owners Association, Inc. of Ledgedale, its members, Board of Directors or employees are not responsible for the conduct, behavior or happenings or cause to happen, of any Property Owner(s) or guests while in the building, on the grounds or traveling to/from or attending any event at this building. Alcoholic beverages are prohibited.

NEWSLETTER - A Community Newsletter named the Indian Rocks Newsletter is issued approximately 3 times per year. This Newsletter is the "sole and exclusive means of communication to the property owners." Any and all notices to property owners required in the Association's fulfillment of its appointed task shall be made to property owners solely and exclusively by and through the Indian Rocks Newsletter.The designation of the Indian Rocks Newsletter as the sole and exclusive means of communication of Association property owners shall not be construed to prevent the Association from also (or in coordination with the Newsletter) notifying Association property owners of any and all matters relevant to the operation of the Association by posted notices, web site, e mail, special mailings and/or like communiqués. Please make certain a "current" address is on file at the Association office. Refer to Resolution NO 1993-3.

OFFICE/ADMINISTRATION HOURS -Monday-Friday 8:00am- 4:30pm. Saturday10:00am -3:00 pm. Sunday 11:00 a.m.-3:00 pm Mother’s Day until Labor Day. Closed Sundays after Labor Day until and including Mother's Day.

PEDDLING - RESOLUTION NO 1994-5. No unlicensed, uninvited peddlers, traveling sales persons and/or individuals engaged in general solicitation shall be allowed within the confines of the Indian Rocks Development. This includes all property owners, family or guests of property owners for any reason. Security provisions of the Community must be provided for along with regulations to generally monitor and control access.


PETS – 1.No animals are allowed to enter Association owned buildings, swimming areas, pool, bathhouse, beaches or tennis courts. Violators are subject to a fine of $100.00 per incident. 2. Animals daily routine is to be taken care of on the individual owners own property. 3.Constantly barking dogs must be kept in the enclosed part of the house. 4. PA State Law and Indian Rocks require current licenses and rabies shots. 5. All animals must be leashed at all times. (refer to DOGS pg.7). 6. Indian Rocks rules allow for only one pet per household.

PICNIC AREAS - Picnic areas are located at Tanners Point Beach, Bear Tract Beach and the area near the Pond. All refuse is to be removed and disposed of by the individual Property Owner. No pets are allowed. Property Owners own grills are allowed, provided all fires are attended and water suppression means are provided at the grill. Extreme caution is advised when disposing of hot embers etc. Use water and dirt to make certain the fire is extinguished completely.

PLAY AREAS - Located in the vicinity of the Pond area and the upper tennis courts and pool. Children 10 or under must be accompanied by an adult. Indian Rocks Property Owners Association, Inc. of Ledgedale assumes no responsibility for any accidents or injuries of any type under any circumstances, caused to or by an individual, Property Owners, guest or any other person, while using these facilities. Caution and common sense should prevail at all times. No food, drink of any type (alcoholic etc.) is allowed.

POND - Located in the rear of the Association office is strictly for Indian Rocks Property Owners use. Current tags must be displayed. The Pond is only for off shore fishing. No ice fishing is allowed. A PA license is required for 16 yr and older. No boats, floats, rafts etc. are allowed on/in the Pond. Swimming is Prohibited. ATV's, bikes or any type of 2, 3 or 4-wheel vehicle, along with snowmobiles, is prohibited on, in or around the Pond area at any time during the year. Ice-skating, skiing, or cross-country is at the Property Owners own risk. The Association assumes no responsibility for any type of traffic, pedestrian or vehicular, or any type of accident involving a Property Owner, their guest(s) on any other person(s) on or in the Pond and surrounding area, or on or in the waters of Lake Wallenpaupack at any time.

POOL MEMBERSHIP FEE - The Pool membership usage fee is set by the Board of Directors. Check with the office for the current year membership fee. Daily passes can also be purchased at the Association office. Children 12 yrs. and younger must be accompanied by an adult 16 years and older.

POOL USAGE - Refer to Beaches/Pool.

PORT 0 LAV - These are located at each beach area during the summer season. They are only for use by the Indian Rocks Property Owners Association members and their guests/renters. There use is of a temporary means and for emergencies. Please respect sanitation methods and do not leave dirty diapers or garbage in or around the port o lav. Be considerate of others.

PROPERTY OWNERS ATTENDANCE AT BOARD MEETINGS. - Refer to RESOLUTION NO 1994-6 & RESOLUTION NO 2000-3. Members in “good standing” can attend the business portion of the meeting. A 15-minute property owner comment session is provided for on the Agenda as an Open Forum. Call the office by the Wednesday before the meeting to notify them of your plans to attend. Questions and/or concerns are appreciated if submitted prior to the meeting.

PROPERTY OWNER (S) GUESTS - refer to Scope of Rules & Regulations in front of Handbook. Responsibility of the Property Owner(s). Guests abide by the same Rules & Regulations as the Property Owner.

PROPERTY OWNERS LIABILITY - The use of ALL Indian Rocks POA. Inc., of Ledgedale facilities is at your own risk. Indian Rocks members are financially responsible for indebtedness incurred by themselves, their children, relatives, their guests or their renters and further shall be held responsible for correcting any damage to Indian Rocks P. O. A. Inc., of Ledgedale property caused by themselves, their children, their relatives, their guests and renters.

PROTECTIVE COVENANTS - Authorization to enforce. Refer to Resolution NO 1996-5.


RENTERS - (Refer to Scope of Rules & Regulations in the front of the Handbook) refer to Resolution NO 1997-2. Property owners who rent their house(s) out for any period of time, week-ends, weekly, monthly or yearly, are required to make the tenant aware and provide them with copies of all the Rules & Regulations of Indian Rocks. Anyone renting for thirty days or more requires additional paper work (check with the office). Car stickers or Guest passes are required to be displayed on all vehicles. The Property Owners must contact the Association office with the name(s), address and telephone number of the renter. In particular, advise all renters/guests about water conservation and that the Association shut off valve is not to be disturbed. If there is an emergency problem concerning the water they are to contact the Association office. Property Owners are to provide trash removal service for renters/guests regardless of the period of time. Ample trashcans, with secured lids, are to be provided. No plastic bags or any other type of bag containing garbage/trash is to be placed outside unless in a secured container. Animals have a tendency to tear into such trash and the clean up is the responsibility of the Property Owner(s). (refer to Garbage removal)
Pick up a copy of the Rental Policy from the Association office
All renters (tenants) are to have an individual copy of the Indian Rocks Handbook. The charge is $7.00/book.

RESOLUTIONS - Authorization to enforce. Refer to Resolution
NO 1996-5.

RIGHT OF WAYS - All Property Owners are advised that Indian Rocks Development, Indian Rocks Property Owners Association, Inc. of Ledgedale will not take responsibility for damage done to any object, recreational vehicle(s), boats or any type of vehicle parked or situated in a right of way. Conformity with this regulation will allow for proper snow removal, ingress and egress of fire and/or emergency vehicles.

ROAD WEIGHT BAN - Refer to Resolution NO 1996-6. NO vehicle over 10,000 lbs. gvw is allowed on any of Indian Rocks roads during the months of December 1 to April 30. This restriction based on weather temperatures, may be temporarily lifted at times during the above-mentioned months at the discretion of the Maintenance Manager. The P.O. and/or the contractor are to call the Association office for direction. Violators of the regulation shall be subject to a fine of $250 - 1st offense; $500 - 2nd. offense; $1,000 - 3rd. offense and responsible for all damage to roadways in question.
RULES AND REGULATIONS - Authorization to enforce. Refer to Resolution NO 1996-5.

SATELLITE DISH - Refer to CABLE TV. Requires ACC application before installation as to location on the house. Size limit is 18" in diameter. A fine of $100.00 is attached to the PO account if plans are not submitted and approved. Location on the dwelling is to be in such a manner to shield as much as possible the dish from view from the street or other common property and neighboring lots.

SECURITY - Part time security presently patrols Indian Rocks. Security has the authority to enforce the Rules & Regulations of Indian Rocks. The Security Guard's duties are to patrol and during these patrols, if they should see anything amiss, bring it to the attention of the managers or take the appropriate steps, depending upon the emergency, to report or contact the State Police. They do not patrol individual houses. This service is separate and has to be contracted for by the particular individual with a Security Company.

Some important means of security that can be undertaken by every Property Owner is to (a) make certain that ALL vehicles owned by Property Owners and/or their guests and all contractors, are identified with an Indian Rocks current year sticker; (b) set timers, at different times, in various areas of the house; (c) maintain sufficient exterior illumination of the property; (d) remove seasonal decorations promptly.

SCHOOLS - Indian Rocks is located in the Western Wayne School District. Hamlin Elementary, on Rte 191 near Hamlin Corners (570)-689-2632; Lake Ariel, in the village of Lake Ariel just off Rte 191 (570)-698-5616; Middle School, South Canaan (570)-937-3010; High School, South Canaan (570)-698-7910.

SLIPS (BOAT) - All boats are to be registered to the Property Owner assigned to the slip. If a boat is placed in a Community dock assigned slip and is not registered to the Property Owner assigned to that slip, the Property Owner(s) automatically removes him/herself from the privilege of leasing a slip on Community Dock. There is imposed a $200.00 fine to the Property Owner, the boat must be removed immediately upon notice, and for every day the boat remains on Community Dock, a fine of $50.00 per day is affixed to the individual Property Owner's account. All privileges (use of the amenities etc.) are suspended until the account is paid in full.

SMOKING - There is a “No Smoking” policy for all buildings belonging to the Association. This includes the Administration building, Maintenance, Meeting Hall and Bathhouse.

SNOW REMOVAL - Snow removal, on Indian Rocks roads, is conducted in-house, by a predetermined route system. Indian Rocks does not remove snow from private driveways. If you hire someone to plow your driveway, please inform the office. This way we are sure anyone entering Indian Rocks with a plow has an intended purpose and is supposed to be there. Park all vehicles, boats etc. off the roads and right of ways to facilitate snow removal. When clearing your individual drive way or walk way, do not throw snow back out into the road. This practice causes undo hardship on all the residents of the Community. It is recommended to clear your driveway/walkways AFTER snow plowing and anti-skid application is completed.

SOLICITATION - No unlicensed, uninvited peddlers, traveling sales persons and/or individuals engaged in general solicitation, for any reason, shall be allowed within the confines of the Indian Rocks Development. This includes Indian Rocks Property Owners.

Any persons violating this Resolution shall be treated as trespassers under the criminal laws of the Commonwealth of Pennsylvania. REFER TO RESOLUTION NO 1994-5.

STAFF - Verbal/physical abuse/harassment of staff and/or other persons is prohibited. Members, tenants and guests are expected to conduct themselves in a courteous and polite manner at all times. Refer to Resolution NO 1997-4.

TAGS AND STICKERS - All vehicles, recreational vehicles and boats are required to have a "current year" Indian Rocks sticker displayed on the vehicle. All stickers are numbered and the particular number is registered to the individual Property Owner. These are available at the Indian Rocks office in January of the current year to members in good standing. Current year tags are also to be displayed by the Property Owners, family members and guests when on property, at the beaches, pond, boat docks and launch and the tennis courts. These are also available to members in good standing at the Association office. Property Owners who wish to have them mailed are required to send a s a s e, with $.60 postage, to the Association office.

Current year boat stickers are to be placed on the side of the boat, facing the shore and are to be seen from the shore with the cover in place. The current years Assessment allows for two (2) car stickers and six (6) tags. Additional car stickers and tags are $1.00 apiece. One (1) boat sticker is provided with the rental fee. Wristbands are $1.00 per band. Info. on ATV stickers and flags refer to ATV Guidelines.
Guest tags, which can be hung on the rear view mirror, are numbered, assigned to the individual Property Owner and can be purchased at the Association office for $4.00 each. This plastic tag can be re-used year after year by purchasing a current year sticker, after the initial purchase, for $1.00.
As of 1/1/06 four(4) tags will be given for each assessment.

TANKS - 1. Above ground/in ground tanks used for heating, are the only tanks allowed. 2. Location is to be in an inconspicuous area in the rear of the house. 3. The tank must be shielded. The preferred method is shrubbery, substantial enough to conceal the entire tank. An alternative method is small lattice fencing around all sides, attached to in ground posts and stained and earth tone brown. 4. In-ground tanks are to be placed in ground according to all Federal, State and Local Laws and Indian Rocks A.C. Guidelines. 5. The specifications and method of placing the tank in ground is to be approved by the Architectural Control Committee. 6. Application is to be in writing to include the lot dimensions, location of the house/additions, the septic field and septic tank and the exact location and set backs of the tank shown on the drawing.

TENNIS COURTS - Double courts are located at the Pool.
1 . Current badges are to be visible on all person(s) in the tennis court area.
2 . Sneakers or a rubber sole tennis shoe is required.
3 . No food, drink of any kind is allowed. Exception water containers - plastic (non breakable).
4 . Only active participants are allowed in the tennis court area. Spectators must stay outside the fence.
5 . No pets are permitted in the court areas.
6 . No smoking in the Tennis Court area.
7 . Keep the courts free from liter, including discarded tennis ball containers and lids.


TREES - As per the Protective Covenants, no trees or brush may be cleared from a lot, for whatever reason, unless approval is received from the Architectural Control Committee. Refer to Protective Covenants.

TV ANTENNAE- Refer to Cable TV and Satellite dish.

VOTER REGISTRATION - Wayne County Court House, Honesdale, PA 18431. (570)-253-5970.


VEHICLE STICKERS - All vehicles are to have current I. R. identification displayed at all times. The preferred location is the back bumper, drivers side. Guest passes can be hung from the rear view window. A fine of $5.00 for each citation issued and the fine is assessed to the property owners account. Refer to Resolution NO 1998-2.
Fine for not having identification displayed is $25.00. Refer to Resolution No. 2004-7.


WATER - SEWAGE - All houses in Indian Rocks are, at present, serviced by on lot septic systems. For additional information contact the Sewage Enforcement Officer of Salem Twp., Gary Enslin, at the township building on Friday’s from 9:00 am to 12:00 noon at (570)-689-4663.

All lots are serviced by a central water system, owned by the Indian Rocks Property Owners Association. At present five (5) in ground wells service the Community. In addition to the wells there is a 212,000 gal. storage tank. The Property Owners Association owns all water valve shut-offs, which are located in close proximity to the property line or the edge of the road. These valves are turned on and off by employees of the Association only and not the Property Owner. If it is necessary to alter this valve contact the Association office, during normal business hours, with a minimum of 24 hours notice. Maintenance will only be available to turn water off or on Monday-Friday, and on Saturdays by prior appointment only. (Refer to Resolution NO 1994-2 for the Board policy regarding the shutting off of water to a developed/non-developed lot for non-payment of the Annual Assessment.)

The following resolution, implementing Rules and Regulations, had been adopted by the Board of Directors at a regularly scheduled meeting on August 8, 1992. "BE IT RESOLVED that all Property Owners at Indian Rocks Property Owners Association, Inc. of Ledgedale, utilizing said central water system be notified of such rules and regulations in a manner determined by the Board which best suits the circumstances, August, 1992 issue of the Indian Rocks Newsletter, AND FURTHER, that any Property Owner(s) violating said rules or regulations be subject to a fine in the following amounts:

1st. violation.....$100.00 + cost of repair. (approx. $165.00)
2nd. violation.....$200.00 + cost of repair. (approx. $165.00)
3rd. violation.....$500.00 + cost of repair. (approx. $165.00)

Each day said violation continues shall be a separate violation. AND FURTHER, any property owner aggrieved by a determination of the Board as to fines may appeal to the Board and have a hearing before the Board, the date and time of the hearing to be determined by the Board, and call witnesses on his/her/ their behalf. NOTHING, herein shall be construed to prevent the Indian Rocks Property Owners Association, Inc. of Ledgedale from taking legal action in equity or otherwise to enforce these rules and regulations."

A LIST OF VIOLATIONS ARE AS FOLLOWS:

1. Improper winterization, freeze-up causing broken line(s).
2. Water continuously running from outside/inside, via hose, spigot etc. to avoid freeze-up.
3. Shutting off or turning on of the Association water valve by the Property Owner or anyone other than an employee of the Association. Damage or breakage to the water valve caused by the above, careless direction of a vehicle or any such misuse.

Some suggestions for winterizing your house are as follows:

1. Drain all water pipes.
2. If you don't already have one, install a shut off valve near the foundation and turn this off to prevent water damage from water coming into the line from the road.
3. Pour anti-freeze in all drains and bowls.


WATER CONSERVATION - at "all" times is of paramount importance. During peak times, July - August and week ends beginning Memorial Day up to and including Labor Day are considered peak times. Washing of vehicles, recreational vehicles or boats is not permitted on weekends. Watering of lawns should be kept to a minimum and only when necessary. If possible use buckets of water. The use of a sprinkler system or a hose, left running for an extended period of time, is prohibited.
REMINDER: if the electricity goes off, no electrical power is provided to sustain the wells pumping system. It is critical that you conserve water during this time.

WATER DISCONNECTION/TERMINATION - The Indian Rocks Property Owners Association, Inc. of Ledgedale through its designated agent, have the authority to shut off and disconnect any and all water service to any property, whether improved or unimproved, for failure to pay the total Special Water Assessment or in the event of non-payment of any Annual Assessment on or before May 1 of any year.


Prior to the disconnection, the Property Manager of Indian Rocks Property Owners Association, Inc. of Ledgedale shall notify said property owner(s) affected by certified mail, return receipt requested, at the last registered address in the Association's records at least ten (10) days prior to said disconnection. The ten (10) day period shall run from the date of mailing by the Property Manager of the letter of disconnection.

All costs associated with the disconnecting of the water and all costs associated with the reconnection of the water, at such time as said property owner is entitled to receive same, shall be a charge against the property owner(s) and must be paid prior to any reconnection. Further, in the event that the disconnection fee remains unpaid for more than thirty (30) days, it shall be added to the current property owner(s) assessment and be collectable as if it were an Assessment under the By-Laws and Covenants of the Association. The Property Owners Association shall not be liable for any damages or injury suffered by any property owner(s) or occupant of any property affected by this regulation.

The website also contains forms to download so if you can’t get to the association office you can get the form from the web and mail or fax it to the office.

WINTER GVW BAN ON INDIAN ROCKS ROADS - Refer to Resolution NO 1996 -6.In place from 12/1-4/30. The GVW limit (includes contractors, delivery trucks etc.) is 10,000lbs. Exception, emergency & fuel delivery.
